Employment Agency Regulations

These regulations were introduced in April 2004 to provide added protection for work seekers and companies using the services of intermediaries. In July 2004 these regulations were extended to cover work seekers who supplied their services through a limited company.

However, those who provide their services through a limited company have an option to opt out of these regulations if they wish. When an assignment is on offer we will ask you whether you wish to opt out but your choice will not affect the offer.

A guide for limited company contractors produced by the Recruitment & Employment Confederation is worth consulting before you make a decision on the opt out. REC limited company contractors guidelines[.pdf]
